Terms of Service

Introduction

These Terms of Service outline Global ProLab, Inc.'s (" we ", " our " or " the Company ") practices with respect to the services we provide and the conditions under which we provide them. Please read the following basic rules as they govern your agreement to purchase services from our Company. Please note that scheduling a service with our Company constitutes your unconditional agreement to be bound by these Terms of Service without modification.

Cancellation Policy

  • If a patient cancels or reschedules their appointment more than 24 hours prior to the appointment, there is no cancellation fee.
  • If a patient cancels within 24 hours of the scheduled appointment, 50% of the draw collection fee will be charged.
  • For patients who are a no-show, 50% of the draw collection fee, as well as IRS mileage standards, will be charged.

Force Majeure

Global ProLab, Inc. shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs, or other serious labor disputes, riots, earthquakes, floods, explosions, or other acts of nature.

Indemnity

You hereby indemnify Global ProLab, Inc. undertake to keep Global ProLab, Inc. indemnified against any losses, damages, costs, liabilities, and expenses (including without limitation legal expenses and any amounts paid by Global ProLab, Inc. to a third party in settlement of a claim or dispute on the advice of Global ProLab, Inc.’s legal advisers) incurred or suffered by Global ProLab, Inc. arising out of any breach by you of any provision of these Terms of Service, or arising out of any claim that you have breached any provision of these Terms of Service.

Severability

If a provision of these Terms of Servie is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Law and Jurisdiction

These Terms of Service will be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, and any disputes relating to these Terms of Service will be subject to the exclusive jurisdiction of the courts of Massachusetts.
